1. SECURITY

We care about your security. While we work to protect the security of your account and related information, we cannot guarantee that unauthorised third parties will not be able to defeat our security measures. Our data is processed and stored within the cloud environment, which allows us to leverage the investments cloud hosts makes into security.

We are concerned about safeguarding your Information. We provide physical, electronic, and procedural safeguards to protect Information we process and maintain. For example, we limit access to this Information to authorised employees only who need to know that Information in order to operate, develop or improve our software, application, site, products or services.

We attempt to identify and deter these threats, but we still remain prone to cyber assaults and intrusions. We endeavour to provide reasonable security for information we process and maintain that no security system can prevent all potential security breaches.

Zetheta shall not be responsible for any loss occurred to the user due to security breaches. In case you have made the payment, and it is not reflected in our account due to issues with the payment gateway then in most cases, the money will be reversed to you automatically by the payment gateway within 3 to 7 working days and if it is still not received by you then you may take it up with the payment gateway. We shall assist you in the process but shall not be responsible for the loss occurred to you due to issues between you and the payment gateway since usually such money lies in the suspense account with the payment gateway and is not received by us.

2. DISCLAIMER

ZeTheta is a technology platform and does not act or provide any services of a broker, sub-broker, investment adviser, financial product distributor, insurance agent, research analyst, portfolio manager, wealth manager, banker, financial adviser in any capacity which is regulated. We are not regulated by any Board/ Authority, and we do not carry out any business which requires licensing/ registration from any Board/ Authority. All the user experiences on our site are virtual experiences attempting to mimic real work like environment. 4. CODE OF CONDUCT

You agree that you will:

  • use your real name on your profile;
  • not give access to the site to any other person and
  • use the Products and Services in a professional manner.

Misconduct undermines the value of Zetheta’s credentials and reputation and devalues the authentic efforts of other users. If you engage in misconduct then you shall be subject to consequences as described below.

Misconduct is defined as any activity which circumvents, or attempts to circumvent, the training experience provided by the programmes of Zetheta, or misrepresentation of the authorship or conditions of completion of programme activities.

You shall be permitted to use or consult others or use publicly available information online (including electronic materials and generative AI tools including, but not limited to, OpenAI/ ChatGPT, Gemini or similar software or applications) on any work within an assignment or task, unless expressly prohibited.

The following standards provide clarification of the most common types of misconduct, but the list is not exhaustive:

(i) Not completion: Not completing all the activities and tasks within the period prescribed for completion.

(ii) Plagiarism: Plagiarism is when you copy or reproduce words, ideas, or any other materials from another source without giving credit to the original author or copy the contents given by Zetheta. Plagiarism also includes the practice of employing or allowing another person to alter or revise your work, and then submitting the work as your own. Plagiarism can also include self-plagiarism, where you submit the same work that you had already submitted for another assignment or task, where this is not disclosed and permitted.

(iii) Fraud: any misrepresentation about the authorship or the conditions under which work within an assignment or task was performed not otherwise specified or falsifying any evidence in support of any mitigating circumstances claim.

(iv) Blanks/ poor work: Submitting blank presentations, documents or spreadsheet or poorly completed work of assignments and tasks given.

(v) Post, transmit or otherwise make available through the site any materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others; (b) defamatory, libellous, fraudulent or otherwise tortious; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) a virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is or is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment (each, a “Virus”).

5. OTHER TERMS

(i) TAXES

All amounts paid by you to us shall be exclusive of all taxes, duties, charges, or cess. If Zetheta is liable for any taxes, duties, charges or cess in any jurisdiction outside India on or with respect to the value of the Products or Services provided (other than taxes levied on Zetheta’s income, such as corporate tax), you will pay to Zetheta an amount equal to that liability upon the provision, by Zetheta, of a valid invoice any time in future.

In case of applicability of any withholding tax on the fees payable to Zetheta, you shall pay such additional amounts as may be necessary such that Zetheta receives the fees it would have received, had there not been any withholding tax imposed. Bank charges, if any applicable while transferring funds to Zetheta shall be borne by you.

(ii) INTELLECTUAL PROPERTY

Zetheta shall retain all rights, title and ownership to Intellectual Property that arises out of the provision of Products or Services including all the information submitted by you on the site and all the data of usages on the site. All right, title, and interest in and to the site and all content, source code, processes, designs, technologies, URLs, domain names, videos, audios, marks, designs and logos forming any part of the site (collectively, “Our Property”) are (a) fully vested in us, our licensors, or our suppliers and (b) protected by applicable copyrights, trademarks, patents, trade secrets, or other proprietary rights and laws.

Nothing in your use of the site or these terms grants you any right, title or interest in or to Our Property except the limited right to access the site for a brief period of your internship.

Unless otherwise expressly authorized by us in writing, you agree not to

  • copy, modify, deep link, rent, lease, loan, sell, assign, sublicense, grant a security interest in or otherwise transfer any right or interest in Our Property;

We and you agree and acknowledge that we and you are independent and nothing in this agreement gives rise to an employment, partnership, joint venture, or other relationship. Our role is to provide training and your role is to receive work like experience and not actually working with us.

(iv) SEVERABILITY

If any provision of this agreement shall be found by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions contained herein, which shall remain in full force and effect.

(v) INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend (at the indemnified party’s option), indemnify, and hold us harmless from and against any and all losses, damages, liabilities, costs (including reasonable advocates fees) and expenses in connection with any claim arising out of or in connection with any content or information posted or transmitted by you using the site or otherwise arising out of your use of the site or use of the site by any third party who is given or gains access to the site due to your action or inaction. We have the right at any time to forego the indemnification and assume the defence of any claim.

(vi) COPYRIGHT INFRINGEMENT CLAIMS

The copyright laws provide recourse for copyright owners who believe that material appearing on the Internet infringes their rights. Promotional Codes are limited in nature and may expire or be discontinued with or without notice. Promotional codes are void where prohibited by law. Promotional codes may not be copied, sold or otherwise transferred. They are not redeemable for cash and are subject to cancellation or change anytime for any reason without notice. We reserve the right in our discretion to impose conditions on the offering of any promotional code. If any payment is made without applying the accurate promotional code in the relevant field where this needs to be entered then no refund shall be made of any part of the discount or promotion that was not availed while making the payment, even if the promotional code was applicable to the payer. For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you need to agree to the relevant terms and conditions applicable to that campaign, promotion or contest.

(ix) OTHER SERVICES INCLUDING MENTORING

Access to certain elements of the products and services including doubt clearance, mentoring services may be subject to separate terms, conditions and fair usage policy including extra fees that we may charge. We reserve the right to determine the criteria for provision of various elements of products or services to the different categories of users based on its policies. Hence, subscription to one or more of the Programmes or registrations do not automatically entitle you to any and all elements of products or services provided by us and we shall be entitled to exercise our sole discretion while providing access to and determining continuity of certain elements of the products or services. We reserve the right to extend, cancel, discontinue, prematurely withdraw or modify any of our products or Services at our discretion.

(x) DEVICES

Our products and services, including the assignments, tasks and content, are compatible only with certain devices, tablets, instruments and hardware. We shall not be obligated to provide workable products and / or services for any devices that are not recognized by us or those devices that may be purchased from any third party which are not compatible with our products and Services. We shall have no responsibility for any loss or damage caused to any device or any other hardware and / or software and/or instrument, including loss of data or effect on the processing speed, resulting from use of our products or services.

(xi) FORCE MAJEURE

If for any reason beyond its reasonable control, including but not limited to, strike, labour dispute, regulation or order of a governmental authority, civil disorder, disaster, act of war, act of God, fire, flood or other emergency condition or cyber-attacks, data loss on cloud platform, downtime on cloud platform, closing down of cloud platform where the site is hosted or closing down of domain name registrant or financial trouble at Zetheta (“Force Majeure Event”), if we are unable to perform our obligations, such non-performance shall be excused and if the Force Majeure Event continues for more than thirty (30) consecutive days, terminate the obligation of Zetheta to provide any products or services, without further liability of any nature.

(xii) GOVERNING LAW

This agreement will be construed, interpreted and applied in accordance with the laws of India as applicable in the state of Maharashtra. The parties agree to submit themselves to the jurisdiction of the courts at Mumbai in the state of Maharashtra.

6. PROJECT, CERTIFICATION & RISK DISCLOSURE FRAMEWORK

This Framework governs structured work projects provided by Zetheta.

Zetheta designs, develops, and administers these Projects independently as part of its platform to assess candidate and student pools for the purpose of assisting potential employers in their hiring processes, institutes in their student assessment processes, and event organisers in conducting competitive and evaluative events. The Projects also serve to provide Participants with practical, hands-on experience and an opportunity to develop industry-relevant skills in an experiential, project-based work learning environment.

Definitions

“Potential Employer” means any entity, organisation, or individual that engages Zetheta’s platform to access or assess candidates for potential hiring, recruitment, or talent evaluation purposes.

“Institute” means any university, college, educational institution, training centre, coaching institute, or similar academic or professional body that engages Zetheta’s platform to assess its students, trainees, or participants on one or more projects of Zetheta.

“Event Organiser” means any entity, organisation, institute, or individual that organises, hosts, or conducts a hackathon, ideathon, innovation challenge, case competition, coding sprint, or any other competitive, collaborative, or evaluative event (“Event”) in which Zetheta participates by providing its Projects and/or assessment services or organizes jury or judges to evaluate submissions made by Event participants.

“Engaging Party” means, as applicable, a Potential Employer, an Institute, or an Event Organiser that has engaged Zetheta’s platform or services, and shall be construed accordingly throughout this Framework.

“Project” means any structured project work, simulation, game, assessment exercise, problem statement, challenge brief, or evaluation task designed, developed, and administered by Zetheta, whether provided through Zetheta’s platform directly, through an Institute’s academic programme, or as part of an Event.

“Participant” means any individual or a person including a corporate entity who participates in a Project, whether as a job candidate, student, trainee, Event participant, or otherwise.

KEY UPFRONT DISCLOSURE

Potential Employers, Institutes, and Event Organisers may or may not, at their sole discretion, choose to list or display their name, logo, brand, or other identifying information on the website of Zetheta for any role description, Event, assessment, or communication for which they engage Zetheta to assess candidates, students, or Event participants.

Where an Engaging Party chooses not to disclose its identity, the Project shall be branded and issued exclusively under Zetheta’s name. Where an Engaging Party chooses to disclose its identity, such disclosure shall be made with the express written permission of the Engaging Party only for transparency and shall not transfer any ownership, liability, or responsibility for the Project to the Engaging Party.

Zetheta may participate in hackathons, ideathons, innovation challenges, case competitions, and similar Events organised by third parties, by providing its proprietary Projects  and assessing the submissions of Event participants. In such cases, Zetheta acts as an independent assessment provider, and Zetheta bears no responsibility for the outcomes based on Zetheta’s Project content, evaluation methodology, scoring, or certification.

Regardless of whether an Engaging Party’s identity is disclosed or not, and regardless of whether the Project is administered through Zetheta’s platform directly or as part of an Event:

  • Zetheta bears sole and exclusive responsibility for the design, content, administration, evaluation methodology, scoring, and certification of all Projects.
  • The Engaging Party is not involved in the creation, review, approval, or administration of any Project, unless expressly agreed otherwise in writing between Zetheta and the Engaging Party.
  • Projects are conducted through Zetheta’s platform or at Events to assist Potential Employers in evaluating candidates for hiring, to assist Institutes in assessing their students’ skills and competencies, and/or to assist Event Organisers in conducting competitive or evaluative events.
  • Participant performance data, scores, analytics, and assessments generated through the Project may be shared by Zetheta with one or more Engaging Parties for recruitment, hiring, academic assessment, or Event ranking and award purposes or at the discretion of Zetheta, disclosed publicly including through social media channels.

Participation in any Project constitutes acceptance of the terms below.

PART I – PARTICIPANT-FACING DISCLAIMER

1. Nature of the Project

This Project is a structured project designed, developed, and administered solely by Zetheta.

The Project:

  • Is created by Zetheta for skill evaluation, candidate assessment, student assessment, Event-based evaluation, and recruitment or academic support purposes or experiential project work based learning.
  • May be used by Zetheta to assess Participants on behalf of one or more Potential Employers for hiring purposes, one or more Institutes for academic or training assessment purposes, and/or one or more Event Organisers for Event evaluation, ranking, or award purposes.
  • May be administered through Zetheta’s own platform, through an Institute’s academic programme, or as part of a hackathon, ideathon, innovation challenge, case competition, or other Event.
  • May or may not carry, display, or reference an Engaging Party’s name, brand, logo, or identity, depending entirely on the Engaging Party’s preference. Where no such information is displayed, the Project is branded exclusively under Zetheta’s name.
  • Does not constitute employment, apprenticeship, consultancy, agency, or contractual engagement to complete work for Zetheta or any Engaging Party.
  • Does not create any employer–employee, teacher–student, or contractual relationship between the Participant and either Zetheta or any Engaging Party beyond this Framework.

Participation is voluntary.

1A. Transparency Disclosure

Zetheta transparently discloses that:

  • Projects administered through Zetheta’s platform or at Events are conducted to assist Potential Employers in evaluating candidates for their hiring processes, to assist Institutes in assessing their students’ skills and competencies, and/or to assist Event Organisers in conducting competitive or evaluative events.
  • Participant performance data, scores, analytics, and assessments generated through the Project may be shared by Zetheta with one or more Engaging Parties for the purpose of recruitment, hiring, academic decision-making, or Event evaluation and awards.
  • Where an Engaging Party has chosen not to disclose its identity, the identity of such Engaging Party shall not be disclosed to Participants unless the Engaging Party independently chooses to identify itself at a later stage.
  • Engaging Parties have no involvement in, and bear no responsibility for, the creation, content, administration, evaluation methodology, or certification associated with any Project, unless expressly agreed otherwise in writing.

2. No Guarantee of Employment, Academic Outcome, or Event Award

Submission of this Project:

  • Does not guarantee shortlisting by any Potential Employer.
  • Does not guarantee interview selection or job offer.
  • Does not guarantee any particular academic grade, credit, or outcome from any Institute.
  • Does not guarantee any prize, award, recognition, or ranking in any Event.
  • Does not guarantee internship, placement, or employment of any kind.

Zetheta makes no representation, warranty, or assurance of employment, academic outcome, Event award, or future association with any Engaging Party. All hiring decisions remain solely at the discretion of Potential Employers, all academic decisions remain solely at the discretion of Institutes, and all Event awards and recognitions remain solely at the discretion of Event Organisers, subject to their respective independent processes and internal policies.

3. Intellectual Property

Unless expressly stated otherwise:

  • All Project problem statements, submissions, structures, scoring rubrics, templates, evaluation methodologies, frameworks, and assessment logic are proprietary intellectual property of Zetheta.
  • No Engaging Party has any intellectual property rights, ownership interest, or co-ownership claim over any Project materials by virtue of having engaged Zetheta’s services or having hosted an Event in which Zetheta participated.
  • Where an Engaging Party’s branding is displayed on a Project with permission, such display does not transfer any intellectual property rights to Participants or any third party.
  • Participants may not reproduce, distribute, commercialise, reverse engineer, or reuse Project materials.

4. Certification & Non-Endorsement

  1. Any certificate, badge, letter of recommendation, score, performance summary, or completion acknowledgment (“Certification”) issued following Project submission shall be issued solely by Zetheta under Zetheta’s name and brand.
  2. No Engaging Party issues, endorses, accredits, validates, sponsors, or is associated with any Certification, unless such Engaging Party has expressly agreed in writing to such association.
  3. Certification:
  • Does not constitute employment or academic accreditation.
  • Does not constitute a recommendation by any Engaging Party.
  • Does not constitute professional accreditation.
  • Does not imply endorsement by any Engaging Party or Event Organiser.
  1. The sole intention of an Engaging Party’s participation is to assess or rank Participants through Zetheta’s platform or at an Event.
  2. Participants shall not represent that they are certified, approved, or endorsed by any Engaging Party based solely on Project participation. Participants may represent that they are certified by Zetheta if such a certificate is indeed issued by Zetheta, and may display such certificate publicly.

Zetheta reserves the right to revoke Certification in cases of misrepresentation, fraudulent submission, or poor quality of work performance discovered after assessment.

Zetheta may score a Participant very low or even a zero or label a Participant as “not job ready” or assign equivalent performance labels if the quality of Project Work submission falls below the threshold benchmark set by Zetheta. Such scores or labels may be viewed by Engaging Parties and used as part of their decision-making criteria.

Zetheta may share multiple analytics, assessment outcomes, and personal data of a Participant with Engaging Parties for recruitment, hiring, academic assessment, or Event evaluation purposes. Participants consent to such data sharing by participating in the Project.

5. Engaging Party Insulation from Liability

Regardless of whether an Engaging Party’s identity is disclosed or not, and regardless of whether the Project is administered through Zetheta’s platform or at an Event, the following shall apply:

  • No Engaging Party bears any reputational risk or liability arising from Project content, methodology, evaluation outcomes, Certification, or any aspect of Zetheta’s platform or operations.
  • No Engaging Party is required to review, approve, endorse, or validate any Project materials prior to their use, unless expressly agreed otherwise in writing.
  • Zetheta assumes sole and exclusive responsibility for all aspects of Project design, content, administration, scoring, and certification.
  • No claim, complaint, grievance, or legal proceeding arising from or in connection with any Project shall be directed at, or attributable to, any Engaging Party.
  • The Engaging Party’s sole role is to receive assessment data and analytics from Zetheta to inform its independent hiring, academic, or Event-related decisions. The Engaging Party exercises its own judgment and discretion in all such matters.

Where an Engaging Party has chosen to display its name or brand on the website of Zetheta against any role or listed their job description, or where an Event Organiser’s Event is associated with a Project, such display or association is solely for informational and identification purposes and does not constitute the Engaging Party’s endorsement, approval, or assumption of responsibility for the Project.

6. Events: Hackathons, Ideathons & Competitions

Zetheta may participate in or provide Projects for hackathons, ideathons, innovation challenges, case competitions, coding sprints, and similar competitive or evaluative Events organised by third parties.

In such cases:

  • Zetheta acts as an independent assessment and project provider. The Event Organiser engages Zetheta to supply Projects and/or to evaluate Participant submissions.
  • The Event Organiser is not responsible for, and has no control over, Project content, problem statements, evaluation criteria, scoring methodology, or Certification issued by Zetheta.
  • Any prizes, awards, recognitions, or rankings at the Event are determined by the Event Organiser in its sole discretion. Zetheta’s assessment scores may be used as one input by the Event Organiser but do not determine Event outcomes.
  • Participants in Events are bound by this Framework in addition to any terms and conditions separately imposed by the Event Organiser.
  • Where Zetheta’s Project is administered as part of an Event, references in this Framework to the Engaging Party shall include the Event Organiser as applicable.

7. Regulatory Examinations & Professional Certifications

Certain roles for which Potential Employers may be assessing candidates through Zetheta’s platform may require statutory, regulatory, or professional certifications.

Where a Potential Employer operates in a regulated sector (including but not limited to asset management or securities markets governed by a securities regulator or a financial institution or bank governed by a central bank or an insurance company governed by an insurance regulator or any other regulatory or supervisory authority or agency):

  • Employment may require clearing mandatory regulatory examinations or training.
  • Zetheta-issued Certification does not substitute for statutory licensing, examinations or training.
  • Participants are solely responsible for reviewing job requirements and clearing required regulatory certifications, examinations or training.
  • Potential Employers retain sole discretion to determine regulatory eligibility prior to hiring.

8. Agentic AI Assessment Tool Disclaimer

Zetheta may deploy proprietary or third-party artificial intelligence systems (“Agentic AI Assessment Tool”) to assist in evaluation with or without human oversight and supervision.

Participants acknowledge:

  • AI scoring is algorithmic and probabilistic.
  • Outputs may contain inaccuracies, omissions, or bias.
  • Scores are indicative evaluation aids and not definitive judgments.
  • Zetheta does not guarantee accuracy, fairness, completeness, or reliability of AI-generated outputs.
  • The submissions if not captured by the system for any reason may get marked zero.

Engaging Parties are required to independently assess Participants prior to making any hiring, academic, or Event-related decisions. Zetheta’s AI-generated scores are decision-support inputs only.

9. AI Governance & Bias Disclosure

Zetheta’s AI systems:

  • Function as decision-support tools only.
  • May incorporate human review where applicable.
  • May reflect limitations inherent in training data.
  • Are subject to periodic recalibration and improvement.

Zetheta does not warrant that AI outputs are bias-free, error-free, or regulator-proof. No automated system makes employment, academic, or Event award decisions. Engaging Parties remain solely responsible for all hiring, academic, and Event outcomes.

10. Financial Services & Regulatory Disclaimer

(Applicable where the relevant Engaging Party is a regulated financial institution)

  1. Project material is solely for educational and assessment purposes.
  2. Any references to mutual funds, financial products, returns, performance data, strategies, or marketing materials:
  • Are illustrative or simulated.
  • Do not constitute investment advice, research recommendation, offer, or solicitation.
  1. Nothing herein is an invitation to invest.
  2. Participants must not rely on Project content for real-world financial decisions.
  3. Official Scheme Information Documents (SID) and Key Information Memorandum (KIM) must be referred to for actual investment decisions.
  4. Past performance does not guarantee future results.

Zetheta disclaims all liability arising from reliance on Project content. No Engaging Party bears any liability whatsoever for Project content created by Zetheta.

11. Regulatory Position Clarification

Zetheta Algorithms Private Limited is a technology platform and does not act or provide any services of a broker, sub-broker, investment adviser, financial product distributor, insurance agent, research analyst, portfolio manager, wealth manager, banker, or financial adviser in any regulated capacity. Zetheta is not regulated by any Board or Authority and does not carry out any business which requires licensing or registration from any Board or Authority.

All user experiences on Zetheta’s platform constitute virtual simulations designed to mimic real work-like environments for assessment purposes. Zetheta does not provide employment or real work to Participants. Zetheta is not a financial influencer and does not make any recommendation to buy, sell, or hold any securities or provide research associated with any listed security.

The structured Projects offered through Zetheta’s platform or at Events do not constitute carrying on any activity requiring registration, approval, or recognition from any regulatory authority or body.

Participation in a Project does not involve:

  • Investment advisory services,
  • Research recommendations,
  • Fund management activity,
  • Solicitation or distribution of securities, or
  • Engagement in any regulated securities market function.

No part of any Project shall be construed as Zetheta or any Engaging Party operating in a regulated capacity under SEBI.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Zetheta shall not be liable for direct, indirect, incidental, consequential, reputational, financial, or opportunity losses arising from participation.
  • No Engaging Party shall bear any liability whatsoever for any aspect of the Project, including but not limited to Project content, evaluation methodology, scoring, Certification, AI-generated outputs, or any reliance placed on Project outcomes by Participants.
  • Neither Zetheta nor any Engaging Party is liable for technical failures or platform interruptions.

Participation is entirely at the Participant’s own risk.

13. Participant Indemnity

The Participant agrees to indemnify and hold harmless Zetheta and any Engaging Party from and against any claims, losses, damages, liabilities, regulatory actions, penalties, or legal proceedings arising from:

  • Breach of this Framework,
  • Misrepresentation (including misrepresenting any association with or endorsement by an Engaging Party),
  • Intellectual property infringement,
  • Unauthorised use of Project materials,
  • Misuse of financial references,
  • Regulatory complaints triggered by Participant’s conduct.

This indemnity survives completion of the Project.

14. Data

By participating in a Project, the Participant acknowledges and consents that:

  • Zetheta may share the Participant’s profile, submissions, performance data, scores, evaluations, certifications, and other Information with one or more Engaging Parties for recruitment, hiring, academic assessment, or Event-related decision-making purposes.
  • Such data may be shared by direct access to Zetheta’s systems or via links (including APIs and WebHooks) to Zetheta’s website, direct data transmission, dashboards, reports, or any other means determined by Zetheta.
  • Engaging Parties shall use such shared data in accordance with their own privacy policies and applicable law. Zetheta shall not be responsible for any Engaging Party’s use of the data once shared.
